Cancellation of plant variety protection or of variety denomination

Plant variety protection shall be cancelled – with retroactive effect to the date of instituting proceedings for cancellation or to the date on which the conditions for cancellation have already existed, whichever is earlier – if, after the grant of protection, the conditions of uniformity and stability of the plant variety are no longer fulfilled. The registered variety denomination shall be cancelled if the holder, after being requested to do so and within a prescribed period, does not verify that it fulfils the conditions laid down in the relevant Act.
